Luxury and Power
1 - Acceptance of These Terms
By accessing or using the Luxury and Power platform (the “Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”).
If you do not agree to these Terms, you must not access or use the Platform or any of its services.
These Terms apply to all visitors, registered users (“Users”), advertisers and sellers (“Advertisers”), buyers, and any other person who accesses, interacts with, or uses the Platform, including its listings, messaging features, search tools, alerts, and other services.
2 - Purpose of the Platform
Luxury and Power operates a premium online classifieds marketplace designed to connect individuals and businesses interested in high-value goods and services with advertisers who publish listings on the Platform.
Categories may include, without limitation:
- Luxury real estate;
- Luxury and collectible vehicles;
- Yachts and other watercraft;
- Private and business aviation;
- Jewelry and watches;
- Fine art and collectibles;
- Luxury goods;
- Other high-value goods and services.
Luxury and Power is a marketplace platform and is not a party to transactions between buyers and Advertisers.
Unless expressly stated otherwise, Luxury and Power does not act as a buyer, seller, broker, agent, representative, escrow provider, financial intermediary, or guarantor of any transaction between Users.
Luxury and Power does not guarantee that a transaction will be completed, that an Advertiser or User will perform their obligations, or that any listing, product, service, price, ownership claim, description, valuation, or other information provided by an Advertiser is accurate, complete, or authentic.
Users and Advertisers are solely responsible for conducting appropriate due diligence, inspections, authentication, valuation, legal review, financial review, and any other investigation they consider necessary before entering into a transaction.
3 - Registration and User Accounts
Certain Platform features, including favorites, saved searches, alerts, messaging, and listing publication, may require the creation of an account.
When creating an account, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.
Luxury and Power reserves the right to suspend, restrict, or terminate accounts that:
- Provide false, misleading, incomplete, or fraudulent information;
- Violate these Terms or applicable laws or regulations;
- Engage in fraud, spam, harassment, abuse, or deceptive conduct;
- Publish prohibited, unlawful, fraudulent, or misleading content;
- Attempt to circumvent Platform restrictions or security measures; or
- Otherwise misuse the Platform.
You may not create or use an account on behalf of another person without proper authorization.
4 - Plans, Subscriptions, and Payments
Advertisers may purchase subscription plans that provide access to different listing limits, image allowances, promotional features, listing enhancements, visibility options, and other Platform functionality.
The applicable price, billing frequency, features, limitations, and other conditions will be presented to you before you complete your subscription.
Subscription payments may be processed by third-party payment providers, including Stripe or another payment processor selected by Luxury and Power.
By purchasing a subscription, you authorize the applicable payment provider to process the charges associated with your selected plan.
Unless otherwise stated at the time of purchase, subscriptions may automatically renew according to the billing terms presented during checkout.
Cancellation, renewal, billing, and refund terms will be governed by the applicable subscription terms presented at the time of purchase and by any mandatory rights provided under applicable law.
Failure to complete payment, cancellation of a subscription, or expiration of a subscription may result in the suspension or removal of listings, loss of promotional features, limitation of account functionality, or deactivation of featured listings.
Luxury and Power reserves the right to change subscription plans, pricing, features, or availability. Any changes applicable to an existing subscription will be handled in accordance with applicable law and the terms disclosed to the subscriber.
5 - Listing and Advertising Requirements
Advertisers are solely responsible for all information and materials submitted to the Platform, including titles, descriptions, prices, photographs, videos, documents, locations, specifications, ownership information, availability, and other listing details.
By publishing a listing, you represent and warrant that:
- You have the legal right and authority to advertise the relevant goods or services;
- The information provided is accurate, truthful, current, and not misleading;
- The listing does not infringe or violate the rights of any third party;
- You have obtained any necessary permissions to use photographs, trademarks, logos, videos, documents, or other materials;
- The advertised goods or services comply with applicable laws and regulations;
- The listing complies with the rules applicable to its category; and
- The listing complies with the limits and requirements of your selected subscription plan.
Luxury and Power may use automated systems and/or human moderation to review listings and Platform content.
Luxury and Power reserves the right, at its discretion and to the extent permitted by applicable law, to reject, edit, restrict, suspend, unpublish, or remove any listing or content that violates these Terms, applicable law, or Platform policies.
Luxury and Power may also take appropriate action when it reasonably suspects fraud, deception, unlawful activity, intellectual property infringement, or other misuse of the Platform.
6 - Prohibited Conduct
You may not use the Platform to:
- Publish or promote unlawful, fraudulent, defamatory, discriminatory, threatening, abusive, or otherwise prohibited content;
- Advertise stolen, counterfeit, fraudulent, or unlawfully obtained goods;
- Misrepresent ownership, authority, condition, authenticity, provenance, price, location, availability, or other material information concerning an advertised item;
- Engage in fraud, scams, phishing, spam, or other deceptive practices;
- Upload or distribute malware, viruses, malicious code, or other harmful software;
- Attempt to gain unauthorized access to accounts, systems, databases, or restricted areas of the Platform;
- Circumvent technical restrictions, subscription limits, security measures, or access controls;
- Collect, scrape, harvest, sell, or otherwise misuse personal information belonging to other Users without - authorization;
- Use bots, crawlers, scrapers, automated systems, or other unauthorized technology to access or interact with the Platform;
- Impersonate another person, business, Advertiser, or organization;
- Use the Platform for any unlawful purpose; or
- Interfere with the operation, security, integrity, or availability of the Platform.
Luxury and Power may investigate suspected violations and take appropriate action, including removal of content, restriction of access, suspension, or termination of accounts.
7 - Messaging, Favorites, and Search Alerts
Luxury and Power may provide internal messaging, favorites, saved searches, and search-alert features to facilitate communication and help Users discover listings.
Luxury and Power does not necessarily monitor or review all communications between Users.
However, Luxury and Power may review, investigate, restrict, or disclose communications or related information when reasonably necessary to investigate reports, suspected fraud, security incidents, violations of these Terms, unlawful activity, or where otherwise permitted or required by applicable law.
Users agree to communicate in good faith and to respect the privacy, rights, and lawful interests of other Users and Advertisers.
Luxury and Power does not guarantee the identity, intentions, legitimacy, financial capacity, or reliability of any person contacted through the Platform.
Users should exercise appropriate caution and conduct independent verification before providing sensitive information, transferring funds, signing agreements, or entering into any transaction.
8 - Intellectual Property and User Content
The Luxury and Power name, trademarks, logos, branding, website design, layout, software, functionality, databases, original text, graphics, photographs, audiovisual elements, and other Platform materials are owned by Luxury and Power or its licensors and are protected by applicable intellectual property laws.
Except as expressly permitted by Luxury and Power, you may not copy, reproduce, modify, distribute, publish, transmit, sell, license, create derivative works from, or otherwise exploit Platform materials.
Content submitted by Users and Advertisers remains the property of the person or entity that owns the applicable rights.
By submitting, uploading, publishing, or displaying content through the Platform, you grant Luxury and Power a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, index, format, adapt, and promote that content solely as reasonably necessary to operate, maintain, improve, advertise, and promote the Platform and its services.
You represent that you have all rights and permissions necessary to grant this license.
Luxury and Power does not claim ownership of User content merely because it is submitted to the Platform.
9 - Disclaimer and Limitation of Liability
Luxury and Power uses reasonable efforts to maintain the availability, security, and functionality of the Platform. However, the Platform is provided on an “as available” and “as is” basis to the maximum extent permitted by applicable law.
Luxury and Power does not guarantee that the Platform will always be available, uninterrupted, secure, error-free, accurate, or free from viruses or other harmful components.
To the maximum extent permitted by applicable law, Luxury and Power is not responsible for:
- The quality, legality, authenticity, ownership, condition, safety, or availability of goods or services advertised by Users;
- The accuracy or completeness of information provided by Advertisers;
- The performance, conduct, representations, or omissions of Users or Advertisers;
- The delivery, payment, transfer, title, inspection, financing, or completion of transactions between Users;
- Losses arising from negotiations or transactions between Users;
- Decisions made solely on the basis of information contained in Platform listings;
- Unauthorized access resulting from circumstances beyond Luxury and Power’s reasonable control;
- Service interruptions caused by third-party providers, technical failures, maintenance, cyber incidents, force majeure, or other circumstances beyond its reasonable control; or
- Any indirect, incidental, consequential, special, exemplary, or punitive damages to the extent such exclusion is permitted by applicable law.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
10 - Reports, Complaints, and Moderation
Users may report listings, accounts, messages, or conduct that they reasonably believe violate these Terms, applicable law, or Platform policies.
Luxury and Power will review good-faith reports using procedures it considers appropriate based on the nature and seriousness of the report.
Actions may include:
- Requesting additional information;
- Issuing a warning;
- Restricting or modifying content;
- Removing or unpublishing a listing;
- Suspending an account;
- Terminating an account;
- Restricting Platform functionality; or
- Taking other measures reasonably appropriate under the circumstances.
Luxury and Power does not guarantee that every report will result in removal, suspension, or other action.
11 - Changes to These Terms
Luxury and Power may update or modify these Terms from time to time to reflect changes in the Platform, applicable law, business practices, technology, or services.
The updated version will be published on the Platform with a revised “Last Updated” date.
Where required by applicable law, Luxury and Power may provide additional notice of material changes.
Your continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
If you do not agree with a material change to these Terms, you must discontinue use of the Platform.
12 - Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Luxury and Power is legally established, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms of Use or the use of the Platform shall be subject to the jurisdiction of the competent courts in the applicable jurisdiction, except where mandatory consumer protection laws provide otherwise.
Nothing in these Terms limits or excludes any rights or protections that cannot be waived under applicable law.
